Terms of Service
Effective: January 1, 2026
1. Scope and Target Audience
These Terms of Service govern the use of DialogHub (“Service”) — an AI-powered automation platform for businesses, providing lead capture, customer communication, and workflow automation. The Service is designed for and directed at businesses and professionals (entrepreneurs within the meaning of §14 BGB). By registering, you confirm that you are acting in a commercial or professional capacity.
2. Service Description
DialogHub provides an AI agent platform with guided onboarding, a website widget for lead capture, automated notifications, and optional digital channels and modules. The Service automates business communication workflows without acting as business management software.
3. Subscription and Trial
The Service is offered as a monthly subscription. A 14-day free trial may be included depending on the selected plan. Pricing is displayed during checkout and may be adjusted with reasonable notice. Subscription management and cancellation are handled through the Stripe customer portal.
4. Cancellation
Subscriptions can be managed or canceled at any time via the Stripe customer portal. Alternatively, deleting your profile within the DialogHub console will immediately cancel the subscription and remove associated data. Cancellation takes effect at the end of the current billing period.
5. Right of Withdrawal (Consumers)
If, notwithstanding Section 1, you are a consumer (i.e., a natural person acting outside of your trade, business, or profession), you have the right to withdraw from this contract within 14 days of registration without giving any reason. To exercise this right, send a clear statement (e.g., by email) to [email protected]. You may also cancel your subscription via your profile settings in the DialogHub console. Upon withdrawal, any payments made will be refunded within 14 days using the same payment method. If you have actively used the Service during the withdrawal period, we may charge a proportionate amount for the services already provided.
6. Customer Responsibilities
The customer is responsible for the accuracy of provided data (e.g., email addresses, webhook URLs, configurations) and for the lawful use of all automations. The customer ensures that its use of the Service, including the content processed through AI assistants and widgets, complies with applicable law.
7. Intellectual Property
All rights to the DialogHub platform, including software, design, and documentation, remain with the provider. The customer retains ownership of all content and data uploaded to or generated through the Service. The customer grants us a limited license to process such data solely for providing the Service.
8. Data Protection
We process personal data in accordance with applicable data protection law. Details are set out in our Privacy Policy.
9. Availability
We aim for high availability but do not guarantee uninterrupted access. Maintenance and unforeseen issues may cause temporary service interruptions. We will endeavor to notify customers of planned maintenance in advance where possible.
10. Liability
Statutory liability provisions apply. For minor negligence, liability is limited to breaches of material contractual obligations (Kardinalpflichten) and to typically foreseeable damages. This limitation does not apply to damages arising from injury to life, body, or health, or to liability under mandatory statutory provisions.
11. Dispute Resolution
The European Commission provides an online dispute resolution (ODR) platform at ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
12. Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The contract language is English. If any provision of these terms is found to be invalid, the remaining provisions shall remain in full force and effect.
